According to claims made by Apogee Software, Gearbox Software owes the Duke Nukem creators more than $2 million in unpaid royalties from sales of Duke Nukem Forever.
Apogee is suing Gearbox, claiming that the developer has breached a contract signed in 2010 which awarded Apogee both advance payments and royalties upon the game’s release.
Gearbox picked up rights to Duke Nukem Forever after original developer 3D Realms failed to complete the game after more than a decade in development back in 2009.
